Hi, hoping for some help. mediation has broken down & ex wants court rather than going to solicitors.

My ex wants the house till the kids are 18 (7-8yrs away). Me to pay half the mortgage & remain on it as she says she can't afford to remove me from it. When it's sold she wants 70/30% split (equity currently £210k house worth £330k) in her favour and also spousal maintaince essentially for 24 years (until state pension age) of £500 pcm. We retain our own pensions (both c: £200k).

I think this is ridiculous. She earns £27k 3 days a week, full time would be £45-£50k but made no attempt to increase hours since we separated (June 24).

I earn £90-£95k, pay £900 in CMS & half mortgage at the mo. Moved out and rent at present. I'd like a Clean Break and offered 67/33% in her favour. Which she's rejected.

im going make a last ditch offer of 85-88%. This would give me enough for a 5% deposit on a smaller house. I just want it done & don't think im unreasonable.

I know it doesn't count for anything but ex had 2 affairs in the last 4 years of marriage with supposed mates. Married 18 years, 2 kids - 1 doesn't stay or see me - daughter 15, son 11 stays 3 nights a week. Ex even said in mediation if I don't give her more money for extras for kids she will ensure the kids know that I'm not paying for stuff for them. It's a disgrace. Any advice? Has anyone got an idea of whether my offer is fair? Thanks

Your ex needs a reality check.
She will only be able to stay in the house if she can afford all the costs of doing so from her own resources and it isn’t bigger than she needs. You’re then looking at a 50/50 split when the time comes.
Given age of kids there is nothing to stop her working full time now.
SM until age 68 won’t happen. If anything she might get something short term so she can find full time work if she can demonstrate a need. Be careful of paying half the mortgage as well as child maintenance now because you are acknowledging she has a need and that you can afford to pay.
How much is the mortgage?
On what basis are you paying CM?
How much is outstanding on the mortgage? You are unlikely to get one in your own name while you remain on the joint one and even less likely if you only have a 5% deposit.

House is 3 bed but had loads of work down, could downsize & save £40-£50k. I pay £500 towards mortgage trouble is if I don’t my credit history is destroyed & my job would be impacted so don’t have a choice. CM is calculated by CMS. I want to buy hence I need a sale of the property so I can get a mortgage with 5% deposit.

Speak to your lender and explain situation. They may agree reduced payments for a time while you sort things out.

While you continue to give her exactly what she wants there is no incentive for her to change anything or negotiate.
