I am in court soon for a non-molestation order with ex. I was hoping that I could add on to the order that I could have sole authority of the sale. We are not married but share a property. Ex stopped paying for the mortgage and does not want to keep the house. Ex has been difficult throughout the selling process, there is a history of DA and this seems to be another aspect of control. Would this order mean that I would not need his agreement for, changing estate agents and the final selling price etc? Would it have to go back to court/a judge for the judge to sign off the final selling price? This makes me nervous as I know this could cause delays. I’m also nervous about raising the issue in court, in case I put ideas into ex’s head.
