Hi everyone - I wonder if you can help, I have 2 issues please?I am going through a divorce and my ex's solicitor is piling the pressure on for me to start the financial process, and keeps threatening to take me to court for me to pay for her legal costs through the courts if I don’t get a solicitor or comply?
  1. The petition for divorce was only started on 14/12/24? Is that legal / ethical? - Is her solicitor allowed to push me to start the process for the financial order yet? I am in the process of finishing the form E, but I'll be honest I can't afford a solicitor so I’m saving money at the moment - I was hoping that it would take a few months so I could save enough for a solicitor to read through the Form E - but her solicitor is pushing to do an exchange of Form E on 29th February (14 days’ time!)....
  2. My ex’s solicitor gave me free advice first but apparently didn’t save my details – she gave me advice that is contrary to the advice she is giving her? I know the same solicitor can’t represent two people in the marriage, but can they give advice? – is this a battle worth starting?
What would you suggest please?

The gap between petition and conditional order is to allow you to sort out financial settlement if possible. Once you have agreement and a conditional order you can have a legally binding financial order.
In financial proceedings each party pays their own costs. Costs orders are rare but can happen e.g. if one party's actions have frustrated the process. This needs to be much more than taking a few weeks to complete a Form E.
If you need support but cannot afford a solicitor you may want to look at our support services for litigants in person.
