Introduction

In Financial Remedy proceedings the court will want to know the income and mortgage capacity of each party as it is relevant to working out how a practical solution for how the housing needs of the two parties can be met.

A mortgage capacity report is an assessment of how much you can borrow for a mortgage, a mortgage capacity report will take in all factors of your situation when assessing.

Who is required to submit a Mortgage Capacity document

Both parties are required to produce Mortgage Capacity information.

It is one of the mandatory documents to be prepared for the First Directions Appointment (FDA).

When is the Mortgage Capacity document due

It is normally due 14 days before the FDA.
