Hi all ,

my ex moved to Dubai in 2016 .

I now want to do the financial settlement but I have no idea where he works or lives .

my solicitor has written to him via email requesting a voluntary disclosure. No reply .

also there’s no way of me enforcing anything or finding out his earnings in Middle East .

what options do I have ? , or can he simply just ignore everything and deny he received anything?,

Are there any assets in the UK? Does he have a UK bank account??

It is possible, although quite long-winded, to get settlement if he does not engage. Any settlement would only be able to include assets held here. If he is employed by a UK company or holds a UK based pension, that could extend the range of what can be achieved.

You could potentially seek 100% of UK assets if you are able to show he has substantial assets held abroad.

You would need to apply to the court for financial remedy and go through the process. The court would need to be satisfied he is aware of proceedings. It may be possible to fast track to final hearing for the judge to make a final order.

Yes an inactive Uk account .

Only Uk asset is our joint house . 300k equity .

No assets abroad and I could not prove it anyway .

He doesn’t have a pension

Not employed by a Uk company either and I don’t know where he works .

Such a nightmare and I can’t send any letters as I don’t have any address either 😞

If there's no urgent need to settle finances you could just wait for him to surface. Or if the email address is one he is known to use, you could ask permission to serve via email or even something like WhatsApp.

It is hard to advise on possible outcomes without knowing a bit more about your circumstances - length of marriage, children, assets etc.

Hi thanks for the reply .

Divorced 2015 but didn’t do finances at the time due to me not being ready or in a good position at that time .

Two children 11/14.

Relationship breakdown, partly my fault as I struggled with him meeting someone else and since recently he’s had two babies .

I’m not sure of his email address or if he still uses it .

My solicitor has sent a letter to that email I had but there’s no guarantee it’s in use or that he will receive it .

Only asset is house with 300k equity. As it’s now been 8 years since divorce I’m better positioned with finances now .

I understand that he would also need a home for his two babies. However I feel I should have all the house .

Could I put to him that if I take the house he can stop child maintenance in lieu of not getting any house equity?.
