What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Woman age 36, husband aged 60.
married in 2018, met in 2015, moved in 2016.
She was renting a good secure tenancy but moved into his property because he couldn't afford it on his own and pay off multiple debts, he purchased in 1994 now worth approx 290.000 was worth approx 190.000 when she moved in.
she has 2 children aged 15 and 12. He has been main father figure since children were aged approx 4 and 6.
he has adult children with no contact.
Since moving in she used her deposit and sale of all furniture for improving the home, kitchen, carpets, they have had new double glazing fitted and a new boiler.
He pays for the mortgage council tax water and his car insurance tax etc, she doesn't drive and cannot afford to.
she pays for everything for children, groceries, gas and electric, pet insurance.
She has also been responsible for purchasing literally everything in the home from everything fridge freezer, oven down to towels and plates and every McDonald's. He is terrible with money accumulates debt, doesnt prioritise spending.
wife does all chores in the household.
he claims mental health ( openly admits to wife he just doesn't want to work again) esa and added her to claim upon moving in.
Receives child maintenance 400pcm from childrens father but they are no contact, fathers choice.
husband was arrested earlier this year for abh but wife got charges dropped after he threatened suicide. He has been mentally and physically controlling and abusive from the beginning and to her children since approx 2019 /2020 this has got gradually worse. Social services became involved.
she desperately wants a divorce, what would she likely be entitled to upon divorce?
thank you!

What is she looking for? Enough for a deposit to put her back in a suitable rented home?

If he couldn’t afford the house on his own before presumably he won’t be able to now?

He'd have to sell or get a lodger to afford it. Surely that wouldn't be fair she improves his home amnd leaves with only a rental deposit she even got rid of her furniture so she wouldn't have that either? Seems like he's done well out of the marriage

You don’t give any details of incomes or other assets so it is difficult for anyone to comment other than ask what outcome is being sought.

It’s a short childless marriage so usually you’ve looking at dividing what you have built up together.

What financial outcome is she hoping for?

No income for either party. He claims esa and she is his unpaid carer. How many years is classed as a long marriage. 8 years cohabitating is short?
So if the property has increased almost 100,000 value shed potentially be entitled to half of that? There’s 20,000 left in mortgage does that come off hers?
The calculator on here doesn’t allow for step children but disregarding her children from it,it’s saying 89,000 to her is that unrealistic?
And what happens to all furniture appliances etc who decides how that’s split? Assuming she leaves the home with the kids while they divorce can she just take everything she has bought with her?

The children are still minors so housing them is a priority. They are children of the marriage even if not biologically his. OP gave up a secure tenancy which has some relevance too.
The question here is what are the options for housing? Is the FMH too big for him alone? What would it cost to buy/rent somewhere big enough to house the children? Could she stay in the FMH until the children are older and afford the costs?

Does he have any other assets ie pension to consider??
