What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

How much is a three bed house where you live?
Are you claiming any benefits you are entitled to?
What is 18 year old doing work/study wise?

Where is your ex living?

Would you be able to afford the mortgage and running costs of the house from your own resources for a couple of years until youngest is 18?

That would at least delay the cost of selling for a few years.

Have you looked into any benefits that may be available once no children are involved? Even if only until you find full time work.

Will you be able to afford to run a house of similar size with whatever your daughters will be contributing?

Who is currently paying the mortgage?

The problem is there isn’t a lot of assets to split even if you have the majority and you wouldn’t be able to afford to run the house anyway.

Have you looked at the cost of renting and whether you would qualify for help with rental costs?

Hi thanks for your reply

I've looked at benefits I cannot see I'm entitled to anything short term?
My ex and I are paying half mortgage each I cannot afford to stay in famiky home but if I got approx 170k equity I woukd be able to buy mortgage free and afford bills with full time job that would only leave him approx 50k but he has much higher earning potential so could use this as deposit. He thinks we should get 50/50 so would not be happy with 50k

What would the courts say? My need is greater than his ?

I'd really rather not rent if possible as woukd just eat away my equity
