What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

When a Legal Aid certificate either expires or is revoked, does the revoked holder of the certificate''s solicitor have to advise the other side''s solicitor?

Thank you for your help.

If it expires then yes they usually would in anticipation of the next certificate, revoked is another matter, some will some will some won''t if the cert is revoked they are not being payed anymore.

Dukey, I am not sure whether you remember me but I have had to sign in under a different user as I couldn''t remember my password.

I wanted to remove my ex husband''s legal aid as I knew he was lying about his earnings.
What I did is I sent all my evidence, asked for confidentiality, wrote to Jonathan Janogly , Justice Minister + head of legal Aid + my MP and Legal aid Manchester. They investigated and it is no longer active.
It took a lot of effort but in the end it was worth it.

Thanks so much for your support.

I have the memory of a very old goldfish, without your original name I''m stuffed, are you saying the cert was revoked or withdrawn? If so maybe post your experience so we can all learn from it, it''s actually fairly unusual though many feel it should be more common, if you life by all means send a private message.

My name was orientalpoppy. Unfortunately I can''t remember my password. I can send you my letter. the important thing is to aim high! So I wrote to Jonathan Janogly, Minister of Justice, and got my MP to endorse it. then I wrote to the Head of Legal Aid. Because the complaint was coming from the Ministry of Justice all the civil bodies had to do a proper investigation. The ex had 21 days to appeal but didn''t. The certificate must have been revoked. I will PM you with a copy of my complaint.

Discharged and revoked make very little difference to the opposing party in real terms but for the person who was in receipt of public funding, they have to repay all of the costs incurred under the revoked certificate.

If a solicitor is acting for a person who has their certificate revoked, they would be foolish not to give notice of this to the opposing party and the court otherwise they will have to deal with incoming communications and potentially attend court without being paid.

And yet some solicitors do Charles, more irritating are solicitors who stop corresponding with their own clients when the cert reaches its limit.
