If the solicitor fails to respond, write another letter stating that as no response has been received you will assume that they are no longer instructed and that you will write directly to their client.

It is worth checking with the court to see if the solicitor is still on the court record.

Charles, I know the certificate has been revoked because I initiated the action to have it revoked. However, his solicitor is still representing him. She is hoping that I will loose my nerve and offer money to settle. Is his solicitor oblige to notify us that he is no longer on Legal Aid but privately funding? Thanks R

Absolutely. There are ramifications in relation to recovery of costs in the event that you obtain a costs order against your ex.

How do you know the certificate was revoked if the solicitor did not inform you?

I know that he is working overtime and that his earnings were more than he stated. I have no proof but he didnt appeal within 21 days.

Dear Members, Today I am in a position to share my experience. Lets call that experience a nightmare. My ex-wife alleged DV against me (Oct 2013). It was false. she took her complaint back and for my 10 yr old daughter we started to live again. After 28 days at 9 am she called the police and i even don''t know why was they summoned. Having said that. Relationship broke. she left the home and took my princess. I started child app In January privately funded and in march she surprised my with legal aid certificate and she started to spend that aid money like dads credit card. She took my for occupation order and went to trial and she lost. Started all the litigations in the book of family law. I was under massive pressure and I borrowed 18000 in 5 months from friends, family just to get a glimpse of my kid. But no success. My parents had come over from abroad to live with me to support. I had to put them on plain overnight as she got exparte occupation order (which I managed to over turn in 3 weeks in full day trial). Finally in June-2014 I decided to gather all her bank details, all overseas bank statements from India, I managed to get 4 statements with a balance above legal aid threshold of £8000 and many other small things and forwarded to email address

After 12 calender days I heard from legal aid seeking my permission to use the evidence provided. I did that and now is waiting. Waited for weeks. Kept them flooded with all sorts of evidence. Even if it made me look stupid. I kept following them. But one thing I realised that they take it very seriously all the complaints and they acknowledge. And today 09.09.2014, I heard the golden words "Legal aid revoked" just before she is in court with me for Ancillary relief in 3 days.

Guys we give our love to people sometimes they don''t deserve. I lost my daughter to a women full of greed for material and disrespect of others. Today I am very happy and it proves onces again that truth always prevails. It took its time, but I learned many things in these last couple of sleepless weeks. I hope everyone fighting for truth and justice gets their share. God bless all. Have faith. It helps.

Dear Members, That was my experience with Legal Aid. Has some one be in my situation. Her solicitor has already informed court about her LA certificate being revoked. But with a possibility of funding it without legal aid. My question is should she not be asked to repay legal aid prior to privately paying for her case. I have anyway raised this with legal aid. One more thing in addition to my last post. Keep LAA informed of all the unnecessary litigations under taken by solicitor as this helped me in my case.
I am due in court on 12.09 so any help before this day would help.
