Confused. Have kids for 4 nights, each week

I think that''s the issue though, with CMS. They will only process a claim where there is a claim. Their website states that where care is shared, neither parent has to pay the other anything. As they then would not be processing the claim, the Consent Order would stay in force, which would mean one of us would have to apply to the court to have it altered. thos all boils back to my having the kids more then she does. And it''s this way primarily because she''s with another fella and my kids appear to want to be with me, more. It''s been this way since we split. And there are other reasons for this. So as of now, my ex is happy for me having them for 4 days. But she could change her mind at any point. And that''s what bugs me. How, why should she assume that she can do that? So I think, ideally, I need to find a way of securing the time I have with the kids. I guess got that, it''s legal advice time. To which I have an spot with a solicitor next week.

You''ll have to either pay the court order for at least 12 months or go back to court to get it changed which given the cost would probably hardly be worth it.

Establish a pattern, enjoy your time with the kids, then renegotiate or use CMS once the 12 months is up.

Do you pay any SM? There is always the danger that she may get this increased to compensate for the loss of CM.
