Hi, I was told that we dont need deemed service order if we have personally served via process server. I was asked to proceed to Decree Nisi by the judge who reviewed my case.

Hi members,

Hope you are doing well.

I applied for divorce last year in Oct 2021, unfortunately that time the online portal was down, so my divorce application reached Bury st edmunds court.

I applied for the deemed service with evidence that my partner has received the divorce notice and is not responding to the court willingly. I don’t know about the whereabouts of my partner so I can’t go for process server, etc.

when I talk to the court’s chat service all they say is there is a huge backlog from the last year, they are still responding to the last year correspondences, etc.

I’m really upset that my divorce has not even reached the first stage of decree nisi so far. One of my friend applied for divorce in April and has got the nisi to be pronounced by end of this month!!

I’m not sure what the court is doing with my application, there is no real update for me.

is there any advice or suggestions?

Write to your MP - -explain that you are experiencing unacceptable delays in your divorce, and that the delays are down to the court (probably because it's understaffed and underfunded). Explain the impact (health, economic, delaying financial resolution, etc) that the delays are having on you. Ask your MP to raise this with the MoJ.

If enough family court users complain to thier MPs about these delays, then maybe something will be done about them.

Is there anything else that I can do to try to speed up the process?

My CO was submitted yesterday and my solicitor informs me that they are taking 4 weeks. Absolutes can be turned around in a day or so
