What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

By all means request a transcript but it sounds like you may have misunderstood the order. I suspect you have three years during which he pays EITHER the mortgage and CMS or global maintenance, with one becoming the other on sale of the family home. That would be much more normal. Otherwise you could string things along whilst someone else paid your mortgage making every excuse under the sun as to why the house is not selling and then only finally selling when all the children are over 18 and then receive global maintenance. Such an outcome would be extraordinary and it is much more likely that you've got three years from now to make yourself financially independent.

Out of curiosity, is the mortgage plus CMS combined a similar amount to the global maintenance?

Thank You,but with just CMS ,I cannot even afford the bills of the house and I have children who are 14,15.
we parted ways with 50-50,20 years of marriage and I am a house wife.
This means I only get CMS in this divorce process and never got my share of spousal maintenance.
I don't want to appeal but just need to see the transcript to know what exactly has the judge ordered.
Guide me what should i do?

You need to complete form EX107.

The ages of your children reinforce my view that the other side's solicitor is probably correct in writing up the order however. But I agree you should get a copy to put your mind at rest.

If it turns out you are right and you ask for the wording to be changed, I would fully expect him to challenge this as the order would be very odd indeed and rather unfair to him.
