Hi

I caught half a Tv report a while ago that I think said that if a cpl are amicable then there is a process whereby you can both use the same solicitor to reduce fees.

Is this correct??

I am not sure about that, but very well there might be.

Unfortunately it is not often that 'amicable' and 'divorce' manange to appear in the same sentence.

But if you feel that indeed your divorce could be amicable, give the number at the top of the page a call and they will be able to advise you further, unless anyone else comes on with good advice.

The same solicitor cannot represent both people in the divorce; each party must have his or her own solicitor that will be looking out solely for his or client’s best interest. Having a solicitor represent both parties goes against the entire point of having a solicitor, which is to have someone working in the best interest of each party independently

by the time we divorce we will have no assets as house is being sorted beforhand so it will just be the actualy divorce precedings if that makes sense

It is very rare this happens but when it does (i have a friend who chose this route and it worked for him and his wife) one sol can draft all nec paperwork etc...but a second sol will have to be invoved to finalise...so yes it can help reduce costs where both parties are agreeable and dont want excessive costs.

There are solicitor mediators - who can deal with both sides. However, I think they are still inclined to charge themselves out at their usual rates (which is not surprising and not unreasonable).

Of course, you could always try a mediator - and if you don't know about mediation, have a look in the WikiLibrary (in free resources).

By the way, contrary to what some people say, it IS possible to have an amicable divorce. Just because the divorce was an act of aggression for them, doesn't mean it has to be for you. Much will depend on the approach and attitude of you and your stbx; if the two of you want to come to a sensible agreement and not rip the other one off, it can be done. I hope you are one of the ones that manages it.

I think the percentage of 'amicable divorces' could be considerably higher, but, for the intervention of some greedy solicitors. Only have to read posts on wiki to hear how memebers have been encourage to GO FOR MORE!!!
Changing the goal posts. Being told that they should be entitled to xxxxxxxxx?????

Perhaps it was time that mediation was 'made' to be part of the divorce process.
