What if you have a private agreement with your ex. She now works full time (15K per year) and claims CTC and WTC.

I pay substantial amount in CM but she also gets 500pm in SM. If there were to be an revaluation of my income with CM as it has dropped, would she be put on the new UC system?

The only thing that will affect when she is moved across to UC is when the government decide to move her across. At the moment only a few postcode areas are receiving UC for new applications only. They are also only accepting applications from single people with no dependents. The government says that all claimants will be moved to UC by the end of 2017 but it was reported last week that they only have 3 members of staff working on the currently non functional IT system (they are supposed to have 50). I personally think the chances of everyone being on UC by 2017 is roughly the same as the chance of there actually being a Nigerian prince who needs my bank account details.

Your payments won''t affect when she is moved to UC. She will also get the transitional protection if she would be worse off under UC until one of the following happens:

• a partner leaving/joining the household;
• a sustained (3 month) earnings drop beneath the level of work that is
expected of them according to their claimant commitment;
• the Universal Credit award ending; and/or
• one (or both) members of the household stopping work.
