Thanks Fiona, that is massively helpful, very kind of you to take the time. I''ve been reading through some of the other threads regarding this matter and came across a thread from a few years back, in which a solicitor had made a response.. When I said earlier that some people say that order - full time education - will carry to uni, and some say it won''t....the below post from the old thread is the type of thing that makes me then question myself... With it being said that after 19 there is no legal responsibility... Am I right to assume that this is with reference to cases where there''s no order with the (ambiguous) wording of ''full time education''?

Thanks again,

Gwynnie

I stand by my previous posts: if the Order was made in England & Wales, the child maintenance liability ceases on or before the 19th birthday.

It ceases either when she reaches 18 or, if still in education/training at the time, it continues until the end of August of the academic year when the training ends. In the worst case, that would be until the 19th birthday.

After that, there is no legal liability. It''s a moral and family question if you want to support her after that point.

I think Will was perhaps posting in haste and writing about another discussion or the CSA. If you read the whole thread he seemed to be contradicting himself. See;

check your court order - mine says full time education and / or territory degree. Thus maintenance is paid throughout the life of the degree.

If your son has applied to his universities, go on their website for the info on student finance & the student finance website. They take the gross income of the main house earner "me" but did give an extra bit because I also have another son / dependent at home.

If you read through the student finance web site you need to log on and act as a "parent/guardian" supporting a student & your son will have to log on as the "student". There is a deadline for completion so check this - you don''t want to go over this. & you have to send off your Decree Absolute (as proof of divorce so it can take longer to sort).

Your son should (depending on your income) get a student grant, a student loan & then the fees. This will prob not be enough (mind you my son''s a bit of a party animal - which doesn''t help financially) :( Heyho. But if your son has a p/t job best to keep it (my son did) & it does not affect any funds he gets.

As for maintenance - ours is a bit hit & miss, & I have to send funds / pay bills regardless for son - so be prepared to feel particularly skint for the next few years :dry:

Good luck to you & your son

Stay strong JJx

Hi gwynnie

Thanks for your post, I am William the Child Maintenance Options consultant. Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. The definition of full-time education is more than 12 hours a week of study, on a course up to and including A level standard.

With you having a court order in place you will need to contact either the solicitor or court where your order was put in place to confirm when your payments will end.

Thanks
William
