In England & Wales and Poland there is no upper age limit per se to maintenance for over 18s in education, although maintenance isn't awarded beyond the early twenties. With some countries eg Benelux in theory maintenance can be awarded for adult children in need at any age. In Poland at least there is no obligation to pay for over 18s if they neglect their studies and under perform.;)

Now that the child is 16, if u stop paying CS, and if Poland is a REMO country, the polish order will probably come to your local magistrates court for a hearing in 6 months time and they will seek to enforce it as a uk order. They will take your ability to pay into account though. You may have to go back to Poland to change the age upto which to pay.

This is the position in Poland according to the European Judicial Network translation;

a maintenance obligation between blood relatives, and the specific category of the child maintenance obligation: In the case of blood relatives, only those in material difficulty are entitled to maintenance. Parents, however, are obliged to provide child maintenance to children who are not yet able to provide for themselves, unless revenue from the child's property is sufficient for his/her maintenance and upbringing. After their eighteenth birthday, children lose their right to maintenance unless they wish to continue their education and their results to date justify such a choice. Moreover, parents are not required to pay maintenance for a child who is over eighteen and, although prepared for employment, takes up further studies and then neglects them, does not make satisfactory progress, does not achieve pass marks and does not take exams within the deadlines set, and so does not complete his/her studies within the time allowed by their study programme;


Although child support ends at 18 in England & Wales children over 18 in education or training may apply for maintenance from separated parents in their own right under schedule 1 Children Act 1889. The courts may award maintenance for over 18s in in education or training under s29 Matrimonial Causes Act 1973 too.

Here in Scotland there is a general obligation for all parents to support their offspring in education until the age of 25 years.
