If you do share care 50:50 then you can apply for CB and should the mother object the matter is then investigated by DWP/HMRC and they make a decision.

That's an interesting point Fiona. How is that arrangement put into place and can the ex. wife object? My son has only just managed to get regular contact with his boys. It was initially suggested by his ex wife every other weekend and one day in the week. however, we had a telephone call from her recently to say that she wanted my son to have more contact. One week on and one week off was suggested. I wonder if she would attempt to retract that if she thought she was going to lose money.

As regards moving back into the FMH - the 'new partner' seems to be in partial residence. I doubt if he is making a contribution to the family home as I believe my DIL is applying for ancillary relief. With a salary of under 20K don't know how my son can keep two homes going.

The CSA will not consider any of your son needs and are only interested in collecting the % amount, even if the demand leads to your son giving up work.

Also if the mother thinks she will lose money because of overnite contact , then she also make that difficult.

I did a calculation in which I calculated that its better to be on benifits than go to work, unless I had a high income. £2300.

eg 1 (On Benifits)
Housing benifits £750
Council Tax £130
JSA £260
Total £1140
CSA deduction £20

Money to Spend £240

Eg (Working) income £1140
Housing rent £750
Council Tax £130
Spare Income £260 (food,travel,gas bill,ele bill)
Total £1140

after CSA demand of £165 monthly only £23.75 a week left to spend on (food,travel,gas bill,elec bill).

Unless you son gets a job which he paid in cash and there no proof of his income, he gona be in trouble.

Goverment wants to collect money to take children out of poverty, but then to put father/NRP into poverty.
