Ok Retrievie, you'd better get on to the CSA asap then.

However, what happens if the £300 you should be getting a month is higher or lower than the CSA rates?

Do they honour the Consent Order or just apply their rules? You'd better ask them that as well.

Its never been to the CSA because when the divorce was drawn up we agreed £300 a month between us and it was put into the consent order.

Yes i could go to the CSA but they won't be able to get me the arrears from last month or this month.I know they work from the date of the claim (as i said my new husband has had lenghty dealings with them).

I just don't understand the point of a consent order is if an ex can just ignore it and expect not to pay for both boys.

Well you can apply to enforce the consent order as Fiona says, but the long term solution is to involve the CSA probably.

I think you can apply via a magistrate to have an order enforced regarding his wages, cheaper and quicker.

Fiona..thats what i thought and have phoned the courts to ask for the appropriate form.

If he is not happy with what he is paying then yes he could go to the CSA and ask them to take it over but he hasn't even done that.

The CSA will only assess payments from the time the CSA receive your application when the court order ceases to have effect. It is in your interest to apply to the court to enforce the consent order and payment of arrears and let your ex apply to the CSA if he wants.

Yes I agree with you - what is the point of a consent order, if you can't enforce it through the court.

Hopefully now you've rung the court to get the form you can indeed sort it out that way.

Out of interest, would going through the CSA get you more money or not?
