Your status says you are already divorced. Did you also have a binding financial agreement.. either by consent or by court order??

does it cover the CM though? I guess if it does he would have to go back to court to get the amount altered.

Did you have financial hearings in court? Did a judge divide up the assets - ie the house etc? Or did you agree a division between you and get a Consent Order from the court?? Or have you just arranged things between you with no legal agreements?

I ask because although CM IS separate, if there has not been a settlement then you need to get it sorted - and his pension will be part of the assets pot.

As far as I am aware we have a consent order from the court, and the amount of CM agreed was all part of the settlement.

I think you need to have a look at the order you have .. how long ago are we talking about? You would both have had to have independent legal advice - or to have talked to a judge about the order.

What was agreed re the division of property and assets? Perhaps you could tell us a little bit about the financial negotiations .. did you get a large share of te equity for example instead of a pension share?

It may well be that the date of the order means it was only valid as far as CM goes for a year ... in which case you are back to the CSA or a voluntary arrangement.
