The man involved isnt refusing to take a DNA test, he literally cannot afford to pay for a DNA test and doesnt see why he should have to pay for one when he isnt on the birth certificate.

The woman takes nearly every penny he earns either through maintenance or through debts THEY aquired that she is refusing to pay so he cannot in any way afford to pay for a dna test. He is not refusing to take a dna test.

Everyone else - thank you for your replies.

he really doesn't have a choice though, does he? If he's not the father, the DNA test will prove it and he won't have to pay for it if he goes through the CSA (they'll only make him pay if he is proven the father). He then won't have to pay any maintenance and can work on the debt situation. He doesn't have to pay for the DNA test up front with the CSA so he has nothing at all to lose (although they charge less if he pays up front than if they do afterwards if he's proven the father).

And not being on the birth certificate doesn't mean much, does it? I know full well that my ex-husband would not have turned up at the registry office to put his name on the birth certificate for no.3 if he'd have needed to. He was far too busy telling people the child wasn't his and keeping his girlfriend happy and than giving a damn about his third child. Thankfully, as we were still married, I didn't need him there. However, him not being there doesn't change the fact that he's the father, does it?!!!

And just how on earth is a woman supposed to 'prove' paternity without a DNA test?!!!

I am still a little confused about what you think should happen here.

As mumtoboys says, the only way to prove parentage is to take a DNA test. If the childs mother is being expected to prove parentage without the father taking a test before receiveing any maintenance payments no father who refuses to be named on the birth certificate and refuses to have a test will ever be called to account, and that cannot be right either.

Given the amount of money that he will be paying in maintenance payments, is continuing to make the payments and not getting DNA test a financially viable option? If he isn't the father then he needs to find the money for the test somehow or spend fortune that he doesn't need to. The status quo will simply lead to suspicisions that he doesn't want a DNA test, especially if the CSA are willing to pay the costs upfront and recover them from him later if he is proven to be the father.
