Tertiary education is university education, so you are supposed to pay until they finish that. I'm not sure whether a court would consider it to include postgraduate degrees, or just an undergraduate one.

I also don't know how a court would regard a gap year. However, I think the term 'gap year' says it all: it indicates the intention, right from the start, to return to full-time education afterwards. So morally you should certainly continue to pay, and I would think it would be an arguable position in court.

I realise full time education includes uni. My issue is with the gap year. My ex and children have not told me what their plans are re school/uni or anything else for that matter for more than 6 years. I don't know where they live or what they do - I'm just expected to pay for it.
