You are obliged to pay child maintenance until september for your son because as a poster says he is still considered to be in full time education until September.

As regards the Consent Order and the SM to your wife. You have fulfilled this obligation.

I have a daughter at university and one about to go. They are both in the middle of taking their father to court for maintenance whilst they are at university under Schedule 1 of the Childrens Act.

Their solicitor wrote to their father asking for some financial assistance for them. He ignored the letter. My daughters were then sent to another solicitor to dicuss mediation. Due to my daughters telling the solicitor about his aggressive and violent behaviour, it was decided mediation would not work.

They have now had to fill forms in and send their income/expenditure (ie amount they will receive for student loans, amount of rent etc. and are awaiting a court date.

University students do need a base and in this case it is my home. However, of course when they visit it costs, more food, more electric/gas etc, so until last year, their father paid the CM he legally no longer had to pay to me for our oldest daughter. Since he met his latest g/f this has all stopped.

As one poster said, you have actually gone over and above what is required I would say and i suggest to send a covering letter with your completed forms explaining this to the courts.

But as regards CM, I think it might be in your best interests to continue paying until September.
