is there any particular formthe csa use to advise the courts , i have been told by the csa its nothing to do with them, even though they have just done re assesssment , my consentb order dates back to 2004 ??
any help greatly appreciated

In the CSA application form there is a box to tick if there is a CM agreement included in a Consent Order dated after March 2003. When the CSA carry out the assessment they should notify the courts using Form N601 and the order then ceases to have any effect from two months after the CSA received the application.

thanks for that , i didn''t fill out a form, as i had a previous , ruling by them which wrapped into a consent order when divorce came through , and now i have have just asked for an amendment due to change in personal circumstances , they only asked me to send in details of the financial change not any other form . should i complete another form and send in ??

When there is a child maintenance agreement the CSA need to be informed so that they close the case. If subsequently after 12 months of the date of a consent order either parent wants the CSA to carry out an assessment they then make a new application. Part 2 of the application asks if there is a maintenance agreement in place and Part 9 the applicant is requested to send a copy of the order.

I think you need to contact someone more senior and better trained at the CSA and explain there is a maintenance agreement included in a consent order and because the CSA is involved you need them to notify the courts so the order can cease to have any effect. Verify this with a follow up letter and a copy of the order.

Just returning to my original conundrum for further advice as situation changes.
My ex is unwilling to change maintenance i pay (thru consent order) for one of my children despite the fact the child now lives with me full time. I know I can go to CSA but put that to one side for the moment.
If I were to stop paying the maintenance for the child that lives with me would the Court enforce payment of arrears if ex asked them to?
(the answer I am hoping for is probably not!)
