What does SM mean? Got a brain block!

I will absolutly continue to pay the mortgage on top of CM until either I am bought out or it is agreed legally that I amentitled to a set amount or a % of future sale.

It''s always difficult to comment without knowing the overall details.
When one party enjoys sole use of a property and can afford to pay it could be said they should the mortgage in lieu of rent for occupying all the property. However, whoever is named on the property deeds is liable for mortgage payments and if payments fall into arrears the lender will chase them for all the payments.

There is a duty for spouses to maintain one another. If the spouse living in the property is financially struggling and the other spouse has the ability to pay the lower income spouse can claim maintenance "pending" the divorce.

one of the reasons my x has to continue paying me what he does is because he set a president. He dictated to me what he was going to give then 2 years later filed for divorce saying he could no longer afford it. Judge pointed out to him that he''s managed just fine up to this point and the fact that he blew his excess cash (he stayed in Army accommodation, much like I presume you wouldn''t be paying out excessively for being at home) was his problem.
It''s a very hard line. Fiona has a good point about how some with the house pay the mortgage in full in leiu of rent for your half.

Also do you pay the mortgage from your account? or do you just give a big lump of money each month?
