You need to look at the exact wording of the letter. It isn't uncommon to agree to share the court costs of the divorce element only and the letter to be worded in such a way that the offer to share those costs doesn't include legal fees. That means paying your own solicitor's bills rather than agreeing not to employ one.

Good point Fiona i assumed as you said in your first post you were being asked to pay half the court costs ie the application fees and not half the cost of the suit, maybe you could have a quick check of the wording.

I'll put a copy of the wording on tonight but it did suggest just half the court fees from my reading on it.

In terms of mediation I will try, although as I was actually going to do this all DIY (with you great wiki - peps help) it would not cost me anything although obviosuly it will now if we go through mediation. In terms of equity in the house we are now in negative equity so don't see many ways of splitting 0!!!!
