And what if their financial situation has changed a lot (to their benefit) and they have refused to provide updated information? Do I make Judge aware at hearing or before so that information can be requested.

You need to submit a statement of issues to the court ahead of the hearing, stating what you are unhappy with re: his disclosure. Eg: "The petitioner/respondent has not provided a recent full and frank financial disclosure. His financial situation has changed dramatically over the past X months." Also take copies of this with you on the day and make sure that the judge understands that your ex now has more money at his disposal than his form E indicates. This is really important, as the judge won't know unless you tell him.

Your Open Offer, which you also need to submit to court ahead of the hearing is just your offered settlement to your ex...in other words you just need to write down what you'd be happy to settle with. I was advised to write down slightly above what I ideally wanted, as this gave me room to negotiate. Make sure it is headed as as an "Open Offer", as this enables it to be used in court.

You also need to send a copy of each of these to your ex at the same time that you submit your copies to court.
