After receiving her indefinite leave to remain, my wife has disappeared with my child. She is in this country and may of gone back to a refuge. She received her ILR on the 8th September 2009 and disappeared with our 18 month gorgeous boy. She returned after a week and said she was upset and down (which is why she went to the refuge) She spent 3 weeks with me and everything seemed fine we were happy e.t.c and even tried for another child. She then said she would like to go back to pakistan to see her mum (she has no further family ere) which I agreed to and she went from here happy and normal with our boy on the 7th october. She had put in a return date of 5th jan 2010 but I subsequently found out she had arrived 4th November. I contacted the police (again) and after a few hour they told me that she had been located and she and child were fine. I found out she was coming back as she wanted me to fly in on the 30th nov so we can spend eid together and return together. Have I been used by her to gain rights in this country and as a baby making machine?

Can I send a divorce petition based on Marriage by deception?

As long as you have been married for at least a year you can divorce using a Petition for unreasonable behavior citing deception as a reason the marriage has broken down irretrievably.

I would be more worried about the child and maintaining contact.

You need to see a solicitor fast with a view to taking out a Prohibitive Steps Order on your wife in case she removes your son to Pakistan without your consent and then fails to return him. I am sorry - but I have seen this kind of thing before and you need to have safeguards put in place. Please see a solicitor immediately.

My emergency contact order I have been told will cover Prohibitive Steps Order. I havent heard anything other than she has cancelled an application for child maintenence. What would be the possible reasons as to why she would do that?

Can I ask why, if you only got back together for three weeks you were trying for another child?
