Oh i see, trouble is they are only to be used when you do both have an agreement, it may have been the case but not now, was the order actually signed and did it go to court?.

The dicri Nisi and Absolute were issued mid 2009, and the Consent Order was applied for in June 2009 and granted in December 2009. We were both in agreement and in January 2010 he want to court to appeal it but with the wrong paperwork. He then got legal aid and made it back to court in March 2010.

So were both in agreement, the court then asked if he had sought legal advice and he wrote a letter to say he had.

So he singed an order and sought advice first, what ground is he using to appeal?.

I harrassed him
he cant remember signing the paperwork although it is his signature
he was suffering from colitis

So it was I was under duress

Ok so why take so long to attempt to set aside.

Does the illness cause memory loss, no.

Was the agreement within the expectation of what a judge would order.

What was the nature of the duress specifically.

On the face of it it's very weak and predictable I've seen much better that still failed.

From Jenuary 2009 to Feb 2009 he was manipulating both I and his new girlfriend to argue with each other. His girlfriend went to the police(I went to New York in Feb 2009 on hols and he wanted to go with but I refused)and on my return he had persuaded her to accuse me of harrassment. He himself never went to the police. All the harassement is alleged from her, her best friend(who I have never met or spoken to) and his brother.

It is such a costly mess and his girlfriend wants money and he wants the two women at war with each other.

He walked away from the entire estate and never paid any maintenance. The estate is work aroung 139k and we have an autistic child. Would the Judge consider it unfair?
