I was married for 30 yrs, stbx was in armed forces for 26 yrs. So we were married the full term of his pension. He left the army 1993 ranked as colour sgt. We separated 2002 and 9 half yrs later I am still trying to divorce. I have had to have his pension actuary valued as he would not do it, had peremptory diet 26/8/2011 and now have options hearing this month. Can anyone please advise me to what happens next ? And what worth of his pension am I entitled to and can I draw shared pension if court grants it, I am now 57 yr old and really want to get on with my life. Signed Desperate :(

New to this site, but have come across this discussion and am curious as to whether the Terminal Gratuity is also to be considered as part of the financial settlement.

Short answer - yes the value of terminal gratuity is included and if you end up with a pension share then you will receive a cash sum when you draw pension so long as the pension share is implemented prior to your ex retiring.

I have been divorced for about 8 years now, I received a 50/50 split on his pension, which I am now about to claim for payment. The pension is mine in my own right. I just want to know if he will be told if I draw it now as opposed to when I am 65

No, it is nothing to do with him, as you say it is now your pension.
