ex's pension provider does not want to provide final cetv

The pension Trustees are the administrators of the scheme. They won't take action in relation to the scheme unless there are clear instructions from the policy holder or where an order is in place (and the policy holder cooperates).

Faced with an order that the pension be transferred 45% to you, that is what they will do. It may have gone up or down since the last CETV but that won't matter as the order is expressed as a percentage.

If you were to seek an order for disclosure of the documentation to which you refer, you would need to provide compelling evidence as to why you believe there has been maladministration by the pension Trustees.

I've worked in the law since pension sharing was introduced (and years before that) and have never come across a situation where a person is questioning the internal figure used by the Trustee to share a fund.

I suspect the motive is within your comment:

"The expert that was used or shall I say the 'expert on the ex's solicitor's books' did not want to follow the Nuffield trust guide even though I said it needs to be."


which suggests that you feel that there is collusion between some parties against you?

thats correct - the order states the percentage and the cetv report- the value, which is nearly a year old

also correct in stating that i do not want to be short changed hence me asking them latest cetv, as they state, before share. Not denying value goes up or down. The judge agreed with them that the value needs to of the judgement date (06/2022)

if they are trusted to do the 'correct' then surely they would provide the cetv value before the share to ease the 'secrecy' and for one to get on with their lives.

hence the reasons for me asking advice on what i can do do get this report.
