CafCass trick and lies

Last year when I first went to court I had a standard phone call from CAFCASS, when the report came back it was apparent my ex wife had been phoned after me which gave her the opportunity to answer any concerns I had then to list her own including her own opinions on the children''s feeling which were then listed as facts. Now I understand they cant keep going backwards and forwards with the phone calls so just excepted it.

A year and a half later we are going though it again due to various problems with the existing order. Cafcass arranged to call me again and during my call I asked about the issues of the last report and the fairness of be not been given the chance to respond. It was then that the CAFCASS officer informed me that my ex wife was supposed to have her phone interview before me this time but she had phoned up and re scheduled asking for a time after my phone call. (more than likely on the advice of her solicitor)

Is this not a bit under the belt? and if the report comes back with inconsistencies again and a pack of lies would I be able to explain to the judge about her under hand tactics?

CAFCASS should treat you both fairly in the report, and the report should focus solely on the facts rather than he said/she said style.

Unfortunately there is little you can do to change CAFCASS practices, so if they''re not willing to speak to you after your ex then there isn''t much to be done.

The report will likely contain any allegations that the parties make, and CAFCASS would need to include allegations made even if they are disputed. The judge should proceed as though any allegations are unproven, which may mean that s/he has to make Directions to examine the allegations.

CAFCASS spoke to my ex on the Friday then me on the following Monday lunch time. I advised that we were in court the very next day which they apparently were not aware of.

Imagine my surprise when in court on the Tuesday 9am I was handed the CAFCASS report dated the Friday and included issues raised in a previous call months before.

On contacting CAFCASS they stated that the report was dated the Friday in error as they sometimes pre-date letters and it was a fair representation of both conversations. And they didn''t budge from this explanation. My case was thrown out of court.

Royal Mail certainly excelled themselves or the CAFCASS officer typed the report and hand delivered it. I was seriously let down.
