Hi i am after some advice please. My son aling with his older brother and sister have been placed on a child protection order by social services due to neglect by their mother. Since in place my son is living with me and his siblings with their father. Social Services reccomendations in place state his mother can not have unsupervised access to any of the children whilst order is in place. My sons mother has told me she is seeking a court order so can get shated access rights to my son and because the recommendations by social services are not legally binding. I have also recently recieved a call from csa saying i must pay her although my son dosnt live with her currently. And also she his claiming the child benefit for my son and his brother and sister which i cant understand,when i called them up they said only one household can claim so where does that leave me?? also with all this going on am i in a good position to get a full parental order for my son.

Is the order for an assessment or emergency protection? In both cases the orders are only temporary until the courts independently review the evidence from all the parties/agencies and come to a final decision.

Have you already put in a claim for CB and is your son registered at your address with the school and his GP?

Hi thanks for reply...He is through school and not been intouch with docs...My Sons mother keeps telling me that she will get social services done for coming to the decisions they have which is an emergency order..and things will go back to how they were...That cant happen my son is so much happier in the current situation. I just dont know why she can still claim the child benefit when he know longer lives with her and claim csa when i have him all the time at the moment

If you haven''t already done so you need to apply for Child Benefit. When there are competing claims there should be an investigation to determine which parent receives Child Benefit. For child support purposes usually the parent in receipt of CB is deemed to the parent with care who receives child maintenance for the benefit of the child.
