Hi out there
Hoping someone can help me with this question.
I''m divorced and my 2 children (16 and 11) live with my ex wife in the FMH. We have recently agreed to sell the house but I now suspect that she has vacated the property and moved in with her new partner. Do I have a right to know where my children reside as she says it''s none of my business.The children reside with her (she doesn''t have a legal residence order) but surely I have some rights ? Also, does she need my permission to take the kids out of the country ? I''m feeling a bit like a second class citizen at the moment !

Hello,

I''m afraid you have no legal right to know where she lives, or where your children live. It is an entirely reasonable request to know where your children are living but you don''t have any rights to be given the address.

If she wants to take the children out of the country for a holiday, then yes, she will need your consent to take the children away. However, you can''t withhold your consent unreasonably.

What kind of contact do you have? Are there any issues with that?

Hi there.
Yes loads of issues with contact. I applied back in 2012 for a contact order (we separated in late 2011) and was granted one for my youngest daughter but not my eldest who had taken badly to our separation so it was thought best to exclude her from the order to allow her to come to terms with things. The order I received was not prescriptive, it said that she had to grant ''reasonable access'' for me to see my youngest. Since then the access has become increasingly sporadic such that I''m lucky to see my daughter once a week and even then it''s at my ex''s house and she never leaves my daughters side all the time I''m there (usually 10 minutes at best). Access is arranged very ad hoc but when I press to see my kids I get told I can''t because they have plans and she''s not prepared to change them or she tells me my kids don''t want to see me and she will not ask them do do something they don''t want. As such my relationship with my kids is pretty much none existent (eg she took them on holiday for the entire Christmas and new year period, about 2 and a half weeks in total) I''ve thought about going back to Court to get something more prescriptive but I''ve no wish to cause my kids anymore upset so I''m stuck between a rock and a hard place. Help !!!!!
