My divorce was finalised last year with my ex-wife having custody of the children which entitled her to a large proportion of our assets under a Clean Break agreement. Due to various circumstances including the intervention of social services due to her physical violence against the children they are now residing with me. My question is, is it possible to re-visit the court order? As it seems unfair that she can walk away with the family house and a significant proportion of my pension while relinquishing responsibility for the children which was the contributing reason that she received such a favourable settlement.

There is an expression in the trade called a Barder event. This was a case where a wife who had got the lion''s share of the joint assets killed the children and committed suicide, with the result that her mother got the loot.

This was subsequently reversed after an appeal. But the rules are drawn quite tightly and intervention will only be in exceptional circumstances.

However if you want to go down this road you need to act quickly ( this is very important ) and get advice from a solicitor who does divorce and nothing else.
