I agree surely if your son is now living with you full time she should now be paying some CM?! I would phone them and see what the cm people say?

If your wife is in receipt of benefits the max she has to pay is £7.50 a week.

I have two boys with me, 19 and 16. Daughter with stbx is 6. Middle son recently moved in with me but I''m still paying the rate as when he was with her. I pay 540 per month direct to mortgage instead of direct to her. She is on benefits, department for work and pensions contribute the remaning 280 for mortgage. If I reduce my payments to what I should be paying then there will be a shortfall on the mortgage that she won''t be able to cover. The problem is that I also struggle financially and doing overtime is how I keep my head above water. Overtime is becoming less frequent. No doubt we''ll end up in court and my guess is that a judge wouldn''t look at it favourably.
