I''ve been paying mortgage in lieu of CM at slightly more than what the cm calculation would be. One of the children I was paying for now lives with me full time. This considerably reduces the payment to the point where I doubt the mortgage could be paid in full. I''m at the early stages of divorce (just had to process serve the Petition after amending it as stbx isn''t cooperating) and unsure whether to keep paying for now. Bearing in mind finances are tight and just got even tighter with my son here. I think court is extremely likely as stbx just isn''t engaging at all and I don''t want to do anything that a judge would construe as negative but at the same time the situation has changed and I can''t keep on paying what I can''t afford and what by cm guidelines I don''t owe!

Is your ex on income support if she is thirteen weeks after claiming tgebenefits agency cover the interest ( only the interest, not repayments, ground rent etc) on a mortgage, have you checked she has claimed.

Have you claimed chikd benefit every little helps.

If you can''t afford it then don''t pay it. Do the CM calculation online and pay that or slightly more.
I think it is right that you inform your ex. You may want to give her a months notice to give her time to sort it all out.

Bear in mind too if your ex is the Mother of your son who is now living with you she should be paying you CM for him.

How many chidren do you have and the ages how much child maintenace are you paying whats the mortgage repayments that you pay interest and repayment of the loan..
