What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have Decree Nisi 8 months ago. Proceedings for Financial Ancillary is under way. Respondent is acting very slow, also one hearing was cancelled due to unavailability of the Judge.

Can I apply for Decree Absolute, knowing that Financial Ancillary is not finalised yet. Can someone let me know, what are the Mian factors of getting Decree Absolute without Financial agreement.

Please note, we already have chid arrangement order in place.

Thanks in advance.

You can apply but an objection may succeed if there are substantial assets in one party's name (house, pension etc).

Thanks for your response.

Just want to be clear on who will make objection. Would court or respondent make objection if there are substantial assets in one party’s name?

Please advise.

It would usually be up to the respondent to object.
