What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

what is better ? filing form E or going with the consent order directly?

My Decree Nisi is done.

filling in form E it is said is very lengthy, a headache with too many attachments .

My question to the forum is :

Can we put forth our demand for financial settlement straightaway without getting into form E ?

I am unsure hence would be grateful for anyone to reply please.

Wishing all members a very happy 2022, may the Heavens bless you with joy and a long happy life.

My best wishes to all the team members on wikivorce too.

If you are in agreement over the finances and you are both fully aware of what's in the pot (and the values), then you can get a Consent Order drafted. Wikivorce have a fixed fee consent order service for £259

If financial disclosure hasn't yet been done, and there's no agreement then disclosure is the starting point. IF you didn't want the headache of completing form E then you could both use the Wikivorce disclosure form - it still requires full disclosure but is a bit more user-friendly. divorce.wikivorce.com/guides-financial-s...cial-disclosure.html

It depends if you have an agreement or not.

If there is no agreement then you will need to apply to the Court for a financial order. The Court will make directions which will include exchange of Forms E and list the matter for a first directions appointment.
