What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all.

I've been getting conflicting advise about what my ex-husband and I actually need for a Consent Order. We are amicable and still living together (incidentally happily!) It's lovely to have my best friend back again, although any hope of a reconciliation is gone.

I am the petitioner and ticked the box for applying to the court for financial orders.

We have had the house valued and have come to a settlement figure that we are both in agreement with. He will buy me out of the MFH with a lump sum payment. I am not pursuing any of his pension. I am assuming we now need to complete Form D81 and get a consent order drafted up by a solicitor but do we really have to go through the hassle of completing form E when we're both so open about our financial situations. I have zero reason to doubt his assets, nor him me. I hate filling out forms at the best of times, especially when it is a pointless exercise for our situation.

Any help would be greatly appreciated

As you are in agreement, and are confident that each other has been transparent in disclosing assets and debts, there is no need to complete Form E - which will be a relief, I'm sure. The D81 doesn't need to be completed until your consent order is drafted.

Wikivorce provide fixed fee consent orders for £259 - see here for more info - Wikivorce Consent Order Service html or call our helpline 012020 805020
