Hi everyone,
I have changed solicitors and had covid and was unable to meet short deadlines for finance hearings eventhough next hearing is in 6 months. Ex husband is threatening to make a costs application on me eventhough there is no hearing for months. Has this happened to anyone and have they ever been successful in getting costs from you eventhough I have no money to pay?

Threatening to make an application for costs is the first step. Applying for that order is the second step.

If you comply with the outstanding directions/orders before any application is made, you can avoid the issue altogether.

In relation to whether an application for costs would be successful, that would depend upon the circumstances of the case. If there is genuine delay caused by changing solicitors and covid the court may find that it is unreasonable to penalise you on costs. The important thing is to catch up now so you are not in default at the point that (a) the application is issued and (b) there is a hearing.
