Dear All,

We had our FH over 3 days in Aug 2022.The judgement was delivered on 15th Sept 2022.My stbx is threatening to appeal what was a fair ruling to both of us. Is he allowed to appeal? If so what is the time limit? Process? Just when I thought that we are done after spending nearly 100k between us with legal bills, My latest legal bill is at 40k despite my self representation. We had SJE for pensions and property valuation. This STBX IS JUST UNBELIEVABLE! Please do shed a light. Thanks.

There is a 21 day time limit to lodge appeal proceedings. It can be extended but only with good reason.

From experience I would say that around a third of people don't like the result and threaten to appeal it either because they don't accept they are wrong or want to rattle their ex. In either case the appeal mostly comes comes to nothing as appeals are rare and successful appeals are rarer still.

In answer to your question: yes, he is allowed to appeal. However, he won't get anywhere if he simply dislikes the Court's decision.

Thanks for your reply. Is this 21 days from the judgement or from the order? I guess stbx will have to apply for permission to appeal, right?
