What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi
My stbx wife is pushing for me to pay spousal allowance to her, in addition to child maintenance payments for our 3 children.

I earn £1k gross per month more than her. I have no savings whereas she had around £5,000 in the bank plus an ISA worth around £50k.

It seems unfair to me to be having to pay spousal maintenance in these circumstances.

Any advice appreciated.

You need to post full details for someone to comment.

The savings will form part of the matrimonial pot so it doesn’t follow that she will keep all of them after the finances are dealt with.

Spousal maintenance is based on her needs and your ability to pay.

A lot will depend on the circumstances so, as above, we need to know more please.
