What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The order from FDR should set out the things that need to be done ahead of the hearing together with deadlines.
At final hearing you will be given the opportunity to introduce your case. A written position statement can do this. You may want to summarise it verbally. It should set out the key issues to be determined and explain what you think the outcome should be and why.
You may be given the opportunity to cross examine your ex and vice versa. Sometimes the judge will ask the questions. It's a good idea to prepare some - remember to focus on financial matters.
You need to know your way round the bundle and be able to direct the judge to the evidence to which you are referring. If you can, include page references for essential reading in your written position statement.
You may be asked to sum up at the end. This will give you chance to point to evidence that supports your case.
The judge may ask you to come back later in the day or even another day to hear the outcome. Sometimes they will propose a written judgement so you'll have to wait for an outcome.
