What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all,

I almost nearing the end of my divorce. Me and my ex husband signed Consent Order and D81. My Solisitor just submitted all paperwork for Court and advise waiting times for approval around 6-8 weeks. I filed for divorce online and wondering if it makes the waiting time shorter. Can anyone share your experiences of how long you waited for your Consent Order to be approved by the Judge? Also, do I need to wait to ask Decree Absolute to be sent to me or wait for the Consent Order to be approved by Judge?

Thank you,

Vic

If you are the petitioner, you will need to apply for the absolute (if divorce started before April 2022). If you applied for divorce after April 22, then you will need to apply for the Final order (if you are the applicant).

Doing the divorce online won't have any impact on the consent order court timeframe as they are separate processes.

Usual waiting time for a draft consent order to be sealed by a Judge is around 8 weeks.
