What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

FH was expected to just to review/bless Consent Order, but at last minute, Respondent did not submit d81 as part of long-standing strategy to delay proceedings, nor present any required docs. hearing was vacated, R disrupted proceedings & judge not happy, adjourned. Applicant now wants FH to be a contested FH, and is prepping for such. is court leave required? how to notify court of this change - just a letter or a particular Form?

Hmm. I am pretty sure you'd need to make an application for directions to contested FH. Have you seen the order from the adjourned hearing? What does that say?
What stage of the court process had you reached? Was there a bundle of documents - forms E etc? Usually the consent order and D81s would be submitted directly to the court and there would be no need for a hearing.
Has the other side had legal advice? Have you? Had they signed the consent order?
