What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi.
I am trying to put together a Consent Order on my own in order to save the costs of a lawyer. I think it is pretty simple. My partner and I need to split money held in an account for us until we agree the split for each person. I need to have a pension sharing order and give some of a DC pension to my partner but not all of the pension. Then she keeps her car and I keep mine. Other than that there is just money we have in other accounts and a little credit card debt. Can anyone help with some examples of consent orders please? All help very welcome!

I really would not advise you to try to draft and submit your own consent order. Legal wording can be very tricky . It is also a good idea to take legal advice on a fair settlement. Both of these services are available cost effectively via this site.

Depending on the size of the pension and available capital, it may be possible to offset pension share against a higher percentage of cash.
It really is impossible to advise though without knowing more about your circumstances.

Hi.

Thanks for the reply. I am not looking to offset pension as I am pension rich and would like to have as much cash as possible. The numbers have been agreed already. It is just drafting the consent order really.

Ok. Well have a look at the consent order drafting and submission service. It really is a false economy to try to do it yourself.
