What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have final hearing coming up and have been LIP up to now. I have recently engaged a barrister and have a zoom call with him this week. His clerk has asked me to draft something for the written submission but other than the details and tramlines i have no idea where to start.

Do I write it like the section 25 in the first person with numbered short paragraphs?

I have no idea of the language to use. I can find nothing on line with a template or examples of how to start this.

Any help much appreciated

I am pretty sure the barrister will write the final submission. They will need notes from you to help. You after all know your own case inside out.
Presumably ahead of your conference the barrister will have read key documents such as the s25.
During it they should ask questions about your position and hopefully provide advice about how to best present it.
I would present a document in note form and include things like any indication from the judge at FDR as well as pointing to key documents that evidence your position.
It's hard to advise without knowing the details but if there are any issues beyond reasons to depart from 50,:50 on a needs basis, you will need to set these out clearly.

Thank you hadenougnow,
This case is being dealt with by written submissions, so not referring to the final submissions although might be more or less the same thing.

I have the barrister on a Direct Access for the day and to include a zoom conference.

Thanks very much
