Hi,
I am acting as LIP and am seeking help with the following please:

1, I have filed for a Financial Application, Form A, and have received a letter detailing the date of the first appointment. Does this letter also get sent to the OS who has a Solicitor representing him from the court or do I need to forward this letter to the OS?

2, My Ex is obstructing the process and his solicitor is very unresponsive. The letter from the court expects me to collaborate with the OS to compile the required documents for the first appointment, how is this possible when he is not responding? He has also failed to respond to any type of mediation session.

Any guidance is much appreciated.

1) The court would normally notify the other party, or issue a clear order asking you to do so. However, it would be a good idea for you to email the other side's solicitor so there is no room for doubt.

2) In the situation where the other side is non-responsive you should make sure you still comply with the deadlines that you have been set by the court. Complete your documents and file them with court and serve them on the other part. Create a log of the communication attempts with the other side and their lack of response. If necessary create the joint documents (such as ES1 and ES2) yourself and complete your part of them.

You might benefit from a small amount of expert guidance during this period leading up to the first appointment - especially as there a some documents you should be preparing which the court may not have fully spelled out in their letters/orders.
