What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

So I seperated from my ex around 2 years ago,we have a joint mortage and around £90k equity ,I met someone around a year ago, we are still together but not cohabiting , I moved in with her for a few months last summer to help with her rent, (obviously will show on bank statements )she has now bought her own place and her friend has moved in with her to help pay towards the mortgage, as I can no longer afford to do so ,I moved out in December and am now back at my parents to try and save to buy or rent my own property so my children can stay over , on the form E , it asks if I'm in a relationship and then asks for her salary , surely this shouldn't matter as we don't live together , should I just state that I am not in a relationship ? As I do not live with my partner and will not be doing so for the foreseeable future ?

Form E asks if you are currently cohabiting or if the intend to cohahit in the next six months.
If you are no longer living together and don't intend to then you can answer no to both. Questions may be asked about what shows up on the bank statements; just answer them honestly. You don't have to give details of her income and assets.
Being in a new relationship does not diminish your need for housing ideally in a property that is big enough for your children to stay.
