What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Anyone have any knowledge on the enforcement of US final orders in the UK

Hi everyone, I'm new here and I'm despartely seeking advice. I've spoken with numerous UK lawyers none of whom have been able to help. My divorce finalised last year. My ex wife is in the US and I'm in the UK. We were married / divorced in the US. We have 1 child. Married for 16 years but separated for the past 8. My ex wife didn't contribute financially at all. I have zero assets other than a property which was put in my name by my parents as part of my inheritance and a part share in another property which again my parents added my name to (along with my siblings) as inheritance after we had separated. I was wrongly advised by my lawyer in the US that inheritance isn't included in the financial split therefore I provided no valuations. My ex wife however at trial produced a spreadsheet of my worth including exagerated values of both the value and number of properties. As I hadn't submitted values the judge awarded the settlement based on her figures alone of which the value is more than double its actual value. He then ordered her 45% which is in actual fact more than 100% of the property value. I have no other assets. My appeal has failed. My question can this financial order legally be applied in the UK as it is based on incorrect information? If so how am I expected to pay? Many thanks in advance for any advice.

Don't know if this helps. www.penningtonslaw.com/news-publications...t%20of%20the%20'debt'.

Is the property in the UK?

If you have been wrongly advised by a lawyer and that's led to a loss is there a case for a negligence claim?
